Cardiff Bay Holiday Apartment - Waterview Terms & Conditions
Please the read the Booking Conditions below. Your submission of a Reservation Form acknowledges your acceptance of these terms.
Booking Conditions
General: Customers renting the property through Cardiff Bay Holidays are referred to as the ‘Guests’ or the ‘Guest’. Cardiff Bay Holidays are the owners of the property and are referred to as the ‘Owners’ or the ‘Owner’. The rental arrangements are made by the Owners and the contractual relationship is directly between the Owner and the Guest.
Arrival & Departure Times: Rentals are for a maximum of four weeks and commence at 1.00pm on the first day of the rental and end 10.00am on the day of departure unless otherwise notified (please note housekeepers will have access on site from 10.00am to prepare for next guests). This period hereafter is referred to as the ‘Holiday’.
The period booked will be stated on the reservation confirmation provided to the guest when they book and cannot be exceeded unless Cardiff bay Holidays give written approval. The Guest will be liable for any cost, of whatever nature, incurred because of an unauthorised extension.
Deposit: When a reservation is made via the reservation form on the Cardiff Bay Holidays website (the ‘Website’, the Guest has 7 days from the day they receive the reservation confirmation to, in which to make a payment to secure the holiday. This then becomes a ‘Booking’.
If a Booking is made six weeks or more before the holiday is due to start, a deposit of one-third of the rent is payable. If a Booking is made less that six weeks before the start of the holiday, the full rent plus any additional charges must be made at the time of the booking. Should the Owners not accept or reject a booking request, the rent and any additional charges paid by the Guest will be refunded immediately.
Security Deposit: A security deposit is due for payment with the Final payment towards the holiday. In most instances this is £50.00. The Owner shall be entitled to deduct from the security deposit the cost of remedying any breach of the Guest’s obligations, together with the cost of any associated service or goods provided to rectify that breach. The whole amount of the security deposit, or the balance after any reduction will be refunded to you within 14days following the end of the holiday.
Final Payment: Unless otherwise agreed by the owner in writing, the price of the holiday shall be the rent for the property as set out on the website at the time of the booking.
Subject to a cancellation, as soon as the booking is confirmed by the Owners, the Guest is liable for payment of the balance of the rent.
The rent is payable for the rental six weeks before the start of the Holiday (the ‘Due Date’) and non-payment by the Due Date may be treated as a cancellation. If a payment is not received by the Due Date, then the Guest will lose their booking and the deposit will be forfeit. The Due Date will be set out on your reservation confirmation.
Changing a Booking: Once the dates of a booking have been accepted by the Owners, the booking can only be changed by treating the original booking as a cancellation. The dates of the Holiday may be changed, providing the property is available for the new dates and the Owners accept the change. In this case, the Owners reserve the right to make an administration charge.
Cancellation: A booking can only be cancelled prior to the start of the Holiday. A Guest who wishes to cancel the Holiday must notify the owners in writing within 7 days of them becoming aware that they cannot take up the Holiday (‘Cancellation Notice’). If a Cancellation Notice is received six weeks or more before the Holiday is due to start the balance will be cancelled. If cancellation is made less than six weeks before the start of the Holiday the balance is payable in full. There is an administration charge of £50.00 for cancellations. In the event of a cancellation the owners will use their best endeavours to secure another booking in the property for the same week. If this is achieved all monies paid for this replacement booking, less the £50.00 administration charge, will be refunded. If due to any occurence beyond the control of the Owners, the accommodation is unavailable as booked e.g, fire, flood, etc, all monies paid to us will be refunded in full but there will be no further liability towards the hirer.
Method of Payment: Cheque, or via Google checkout (credit card, debit card) invoice which will be sent when the booking is confirmed. For bookings made within 24 hours of booking cash on arrival accepted.
Complaints: All complaints must be notified to the Owners as soon as reasonable practicable, as the Owners may be required to carry out an on-the-spot investigation and if necessary, request the Owner to take remedial action. Should you have a complaint, please allow the Owners the opportunity to put matters right during the Holiday.
Pets: Pets are not permitted in the property. We regret that the Owners are not able to guarantee that no pets have been previously kept in the property.
Linen: Bed linen is changed between rentals. Bed linen changed regularly for longer periods of rentals. There is no additional cost for bed linen. All beds will be made up on arrival. A set of towels is included in the property.
Parking: The property has an allocated parking space for one car under the building (upper level).
VAT: The property is not registered for VAT, in which case no tax is payable.
Condition of Property: Please ensure that you follow the instructions in the Welcome Manual of the property on your departure. A house keeper report is provided to the Owners when you have left and any losses, damage or any cleaning necessary over and above normal servicing, will be invoiced to you on departure. By sending the reservation form, you authorise us to deduct payment for these from your security deposit.
Property Inventory: We are advised by Visit Britain to provide a full inventory of the property for your convenience. Please check it at your leisure and advise the house keeper of any concerns you may have. Incidentals not affecting your holiday should be highlighted to the Owners on your departure.
Personal Property: Any personal effects left by the Guests can be forwarded to their home address. Unclaimed articles will be disposed of after 28 days.
Website Descriptions: The owners reserve the right to amend prices quoted, due to errors and omissions. Whilst every endeavour is made to portray a true representation of the property, no guarantee can be given to the accuracy of the photographs or descriptions.
The Guest’s Obligations: The Guest has the right to occupy the property for a Holiday only (within the meaning of schedule 1, paragraph 9 of the Housing Act 1988). The Guests agree;
a) That in no circumstances should overnight accommodation be provided to guests other than those outlined on the Reservation Form unless the Owners are notified in advance.
b) To undertake to pay for any losses or damage to the property caused (reasonable wear and tear excepted)
c) To take good care of the property and leave it in a clean and tidy condition at the end of the tenancy.
d) To permit the Owners reasonable access to the property.
e) Not to causeb an annoyance or become a nuisance to occupants of adjoining premises.
f) Not to smoke at a non-smoking property.
In the event of a breach of these terms and conditions, the Guests may be required to leave the property during the period of the booking.
Liability: The Owners do not accept liability for any act, neglect or default on the part of the Owners or any other person not within their emply, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property, which the Guests or anyone connected with the Holiday may incur. We reserve the right to provide alternative accommodations or cancel owing to unforseen circumstances beyond our control. If for any reason beyong the Owners control, the property is not available on the date booked (owing to fire damage for example) or the property is unsuitable for a Holiday, all Holiday payments and additional charges paid in advance by the Guests will be refunded in full, but the Guests shall have no further claim against the Owners.
The Owners are not and shall not be held responsible for and maintenance/building works taking place outside the rental property. Where possible the Owners will notify Guests if aware of any works taking place. No claim or liability shall be accepted by the Owners.
Disclaimer: The property is used at your own risk. The balcany or elevated terrace are used at your own risk. Parents should ensure that their children are supervised in such areas at all times.
Governing Law & Jurisdiction: The contract is deemed to have been made at time of confirmation of booking. The construction, validity and performance of this Agreement shall be governed by English Law. The Guests submit to the exclusive jurisdiction of the English Courts.
Authority to Sign: The person who sends the reservation form certifies that he or she is authorised to agree to the terms and conditions on behalf of all persons included on the booking form, including those substituted or included at a later date. He or she agrees to take responsibilty for the party occupying the property.
Discrepancies: In case of a discrepancy between these Booking Conditions and any other contents of the Cardiff Bay Holidays website, these conditions shall prevail, but this shall not limit the Owners liability for failure to supply the accommodation as described on the website.
In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the raminder of the Booking Conditions, which will continue to be valid and have full force and effect.
